Terms of Service

Effective Date: August 25, 2025

These Terms of Service ("Terms") govern your access to and use of the LuxRite Travel website, client dashboard, and concierge travel‑planning services (collectively, the "Services"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.

1) Who We Are

LuxRite Travel ("LuxRite Travel", "we", "us", or "our") provides professional trip design, itinerary planning, booking facilitation with third‑party suppliers, and concierge support. We are not a common carrier and we do not control the operations, policies, or performance of airlines, hotels, tour operators, or other suppliers (collectively, "Suppliers").

2) Services & Relationship With Suppliers

  • Trip Design: research, recommendations, route and date optimization, and budget matching. Deliverables are digital (proposals, confirmed itineraries, confirmations, vouchers).
  • Booking Facilitation: upon your approval, we place/confirm reservations with Suppliers using their fare rules and contracts. Your contract for travel services is with the applicable Supplier, not LuxRite Travel.
  • Supplier Terms Control: Supplier terms (including change/cancellation/refund rules, schedules, entry requirements, and fees) govern those bookings. We will provide or point you to the applicable Supplier terms at or before booking.

3) Payments, Fees & Refunds

  • Planning / Service Fees: due at the time stated during checkout/engagement. Unless expressly stated otherwise, planning/service fees are non‑refundable once work begins(research, outreach to suppliers, or delivery of a first draft). We may offer a 24‑hour cooling‑off window before work starts; see our Refund Policy for details.
  • Supplier Payments: deposits and balances paid to Suppliers are subject to Supplier rules and may be non‑refundable or subject to penalties. We will disclose the Supplier’s terms in writing prior to payment and act per your authorization.
  • Processing: We process payments via third‑party processors (e.g., Stripe and/or other processors we make available). We do not store full card numbers. All amounts are in U.S. dollars unless stated otherwise.
  • Agency Service Fees on Bookings: ticketing, re‑ticketing, changes, concierge add‑ons, and similar services may incur additional non‑refundable agency fees once performed.
  • Chargebacks: You agree not to initiate a chargeback where we have delivered services per these Terms and the disclosed Supplier rules. We will provide documentation upon request.

4) Client Responsibilities

  • Provide accurate, complete information (including names as on passports) and notify us of changes.
  • Review all itineraries and confirmations promptly and report discrepancies within 24 hours.
  • Comply with destination entry/exit, visa, vaccination, and health requirements; these vary by country and are your responsibility.
  • Obtain appropriate travel insurance; we strongly recommend coverage for medical, trip interruption, cancellations, and supplier default.
  • Abide by Supplier rules (check‑in times, baggage limits, conduct policies, etc.).

5) Intellectual Property & License

The Services, including all content, designs, logos, and itinerary formats, are owned by LuxRite Travel or our licensors and are protected by law. We grant you a limited, non‑exclusive, non‑transferable license to use digital deliverables for your personal, non‑commercial travel purposes. You may not copy, modify, distribute, or create derivative works without our prior written consent.

6) Prohibited Uses

You will not misuse the Services, attempt to interfere with security or access controls, reverse engineer or scrape the site, or use the Services for unlawful purposes.

7) Disclaimers; Force Majeure

The Services are provided "as is" and "as available" without warranties of any kind, express or implied. Travel involves risks outside our control. We are not responsible for acts, errors, omissions, or representations of Suppliers, government actions, weather, epidemics, strikes, war, or other force‑majeure events. Schedules and services may change; additional costs may apply per Supplier rules.

8) Limitation of Liability

To the fullest extent permitted by law, LuxRite Travel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, even if advised of the possibility. Our aggregate liability arising from or relating to the Services will not exceed the greater of (a) the fees you paid to us for the applicable Services in the 6 months before the claim or (b) $250. Some jurisdictions do not allow certain limitations; in those cases, the limitation will apply to the maximum extent permitted.

9) Indemnification

You agree to defend, indemnify, and hold harmless LuxRite Travel from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Services, violation of these Terms, or violation of Supplier rules.

10) Privacy & Cookies

Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to electronic communications and to the use of cookies and similar technologies as described there.

11) Dispute Resolution; Governing Law

  • Informal Resolution: Contact us at admin@luxritetravel.com. We will try to resolve disputes in good faith within 30 days.
  • Binding Arbitration; Small Claims: Except for claims brought in small‑claims court, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration on an individual basis. No class actions or class arbitrations. You may opt out of arbitration within 30 days of accepting these Terms by emailingadmin@luxritetravel.com with your name, email, and a clear statement of your opt‑out.
  • Venue & Law: These Terms are governed by the laws of the State of [Maryland], without regard to conflict of laws principles, and applicable U.S. federal law.

12) Termination

We may suspend or terminate access to the Services at any time for conduct that, in our reasonable judgment, violates these Terms or is otherwise harmful. You may stop using the Services at any time. Terms that by their nature should survive termination will survive (e.g., payments due, intellectual property, disclaimers, limitations of liability, dispute resolution).

13) Changes to the Services or Terms

We may modify the Services or these Terms from time to time. If we make material changes, we will post the updated Terms with a new effective date and, when required, notify you by email or dashboard notice. Continued use after changes become effective constitutes acceptance of the updated Terms.

14) Miscellaneous

  • Entire Agreement: These Terms plus any order confirmations and our Privacy Policy are the entire agreement.
  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • No Waiver: Failure to enforce a provision is not a waiver of the right to do so later.
  • Assignment: You may not assign these Terms without our consent; we may assign them as part of a corporate transaction.
  • Notices: We may send notices to the email on your account or by posting to the site.
